SMS Compliance Terms of Service

1. Overview
These SMS Compliance Terms of Service ("SMS Terms") govern your use of SMS messaging features through CallsOrbit. By registering for SMS capabilities, you agree to these terms in addition to our general Terms of Service.
2. Registration Types
2.1 10DLC Registration
10DLC (10-Digit Long Code) registration enables you to send SMS messages from a local phone number. This requires business verification through The Campaign Registry (TCR).
- Standard Brand: For businesses with an EIN (Employer Identification Number). Supports multiple phone numbers and higher message throughput.
- Sole Proprietor: For individuals without an EIN who use their SSN for tax purposes. Limited to 1 phone number per campaign with lower message throughput.
2.2 Toll-Free Registration
Toll-Free registration enables you to send SMS messages from a toll-free number (1-800, 1-888, etc.). This requires business verification through carriers but has a simpler verification process.
3. Fees and Payment
3.1 10DLC Fees

3.3 Non-Refundable Policy
IMPORTANT: ALL REGISTRATION FEES ARE NON-REFUNDABLE
This includes:
- Rejected registrations
- Suspended campaigns
- Account cancellation after registration
If your registration is rejected, you must pay all applicable fees again to resubmit a corrected registration.
4. Your Responsibilities
4.1 Accurate Information
You must provide accurate business information during registration. Misrepresentation may result in registration rejection or campaign suspension without refund.
4.2 Legal Compliance
You must comply with:
- Telephone Consumer Protection Act (TCPA)
- CAN-SPAM Act
- Carrier messaging policies
- All applicable federal and state laws
4.3 Consent Requirements
You must obtain proper consent before sending SMS messages:
- Customers must opt-in to receive messages
- Provide a clear way to opt-out (e.g., reply STOP)
- Honor opt-out requests immediately
- Maintain records of consent
4.4 Prohibited Content
You must not send:
- Unsolicited marketing messages
- Messages to numbers that have opted out
- Content that violates carrier policies
- SHAFT content (Sex, Hate, Alcohol, Firearms, Tobacco)
- Phishing or fraudulent content
- Content promoting illegal activities
5. End-User SMS Consent (Appointment Reminders)
This section describes how end-users (customers of businesses using CallsOrbit) consent to receive SMS appointment reminders and notifications.
5.1 Verbal Opt-In Process
When customers book appointments through a business using CallsOrbit's AI voice agent platform, they are explicitly asked:
"Would you like to receive SMS appointment confirmations and reminders? Message and data rates may apply. You can opt out anytime by replying STOP."
Only customers who verbally confirm "yes" or provide affirmative consent are enrolled in SMS notifications.
5.2 Opt-In Confirmation Message
After providing verbal consent, customers receive an initial SMS confirmation:
"[Business Name] via CallsOrbit: You're now opted in for appointment reminders. Msg frequency: 1-5 per booking. Msg & data rates may apply. Reply HELP for help, STOP to cancel."
5.3 Message Types and Frequency
End-users may receive the following types of messages:
- Appointment confirmation messages
- Appointment reminder messages (typically 24 hours before)
- Rescheduling notifications
- Cancellation notifications
Message frequency: 1-5 messages per appointment booking.
5.4 Opt-Out Instructions
End-users can opt out of SMS messages at any time by:
- Replying STOP to any message
- Replying CANCEL, UNSUBSCRIBE, or QUIT
- Contacting the business directly
Opt-out requests are processed immediately. After opting out, end-users will receive a confirmation message and will no longer receive SMS notifications for appointments.
5.5 Help Instructions
End-users can reply HELP at any time to receive assistance information, including how to opt out and contact details.
5.6 Data Rates
Message and data rates may apply. End-users should contact their mobile carrier for details about their messaging plan.
6. Limitations
6.1 Sole Proprietor Limitations
- Maximum 1 phone number per campaign
- Maximum 3 brand registrations per verification phone number
- Lower message throughput limits
6.2 Service Availability
SMS capabilities are available only after registration approval. We do not guarantee approval timeframes. Typical approval times are:
- 10DLC: 2-3 weeks
- Toll-Free: 5-7 business days
7. Suspension and Termination
7.1 Grounds for Suspension
We may suspend your SMS capabilities if:
- Your registration is suspended by TCR or carriers
- You violate these terms or TCPA requirements
- Your account is in bad standing
- We receive excessive spam complaints
- Carriers flag your messages for filtering
7.2 Effect of Suspension
Upon suspension, monthly fees continue until the campaign is formally cancelled. No refunds will be provided for the suspension period.
8. Data Handling
8.1 Sensitive Information
We do not store your EIN (Employer Identification Number) or SSN (Social Security Number). This information is transmitted directly to Twilio and The Campaign Registry (TCR) for verification purposes.
8.2 What We Store
We store only:
- Registration status
- Business name (for display purposes)
- Twilio reference IDs
- Acceptance timestamps and IP addresses for legal compliance
9. Limitation of Liability
CallsOrbit is not liable for:
- Registration rejections by TCR or carriers
- Carrier filtering or blocking of messages
- Message delivery failures
- Lost business due to SMS unavailability
- Third-party actions affecting your registration
10. Changes to Terms
We may update these SMS Terms at any time. We will notify you of material changes by email or through our Services. Continued use of SMS features after changes constitutes acceptance of the updated terms.
11. Relationship to General Terms
These SMS Terms supplement our general Terms of Service and Privacy Policy. In case of conflict between these SMS Terms and the general Terms of Service regarding SMS features, these SMS Terms shall prevail.
